An Alabama couple who own an ice cream shop now face criminal charges after confronting a customer in a McDonald’s parking lot over a negative online review, creating a viral encounter that lasted nearly 15 minutes and ended with an assault allegation.
Parking Lot Confrontation Turns Violent
Malary and Ryan Goldman, owners of The Local Scoop in Bay Minette, tracked down customer Daniel Smit three months after he posted a one-star review complaining about a botched order. The June 7 encounter, which Smit recorded on his phone, shows Malary Goldman launching into an angry tirade. She told Smit she was furious because she had worked hard building her business and accused him of trying to destroy it.
The confrontation escalated quickly as both parties exchanged insults about personal appearance and finances. Malary Goldman then issued what prosecutors viewed as a threat, warning Smit to stop involving himself in her business or she would take action. Her husband Ryan arrived at the scene and joined the verbal assault. During the altercation, Smit claims someone knocked his phone from his hand.
Both Sides Issue Apologies
After the video went viral and charges were filed, Malary Goldman released a public apology expressing embarrassment over her behavior. She acknowledged allowing frustration to build over time until it exploded in the parking lot incident. Goldman also claimed personal information about her had been shared online, though she admitted this did not justify her actions during the confrontation.
Smit responded by requesting prosecutors drop the charges, stating on social media that social justice had been served. He told local news outlets he felt ashamed of his role in the incident and apologized to Malary Goldman for making her angry. Both parties indicated they wanted to move past the situation and avoid further legal proceedings.
Small Business Review Culture
The incident highlights tensions between small business owners and online review platforms that allow customers to publicly criticize companies. While negative reviews can damage new businesses struggling to establish themselves, experts warn that confronting reviewers almost always backfires. The Goldman case demonstrates how social media amplifies disputes that previous generations might have resolved privately, turning local conflicts into national news stories that can permanently damage business reputations far worse than any single bad review.

You can please some of the people some of the time…… and some just like to bitch….
The customer was probably right. Stire owners proved they are unstable. People should not go there
She probably damaged her brand far more than one bad review could. The reviews average out. If she is doing well, then his review is meaningless. If people are afraid they might be targeted for bad reviews, they might not want to go there at all. That was probably the worst thing she could have done. The apology was a good idea, but once the genie is out of the bottle the internet tends to be very unforgiving.
I think by apologizing they righted the ship. I don’t feel that anyone was seriously affected by this story and I’m sure that they have lots of steady customers that pay little attention to reviews from annonymous sources.
its sad, yhr internet has made it so easy for people to turn momentary frustration into a major incident. Some frustrating incidents can either be taken for what they are — momentary. To destroy a business or a persons livilihood or to make a mountain out of a mole hill is very immature. Life happns and be aware that you too have probably goofed up something so think about it. Before you criticize othrs, has you job performance been flawless? Was your mistake worth getting fird for?
I replaced a truck side mirror it was a very easy job much easier than most mirror jobs but I charge your regular price. the customer accuse me of ripping him off . All that did was piss me off so didn’t lower the price at all . Now if he would of said ” man that more expenive than I thought it would be nicely . I would of gladly lower the price . because he was right it was a rip off . now the charge was not a rip off for a regular replacement of a truck side mirror.
The 64K question is….; How did Malary Goldman track Smit down in a McDonald’s parking lot three months after the review?
They botched his order so I’m sure they could figure it out. Esp if he was using his full name on the Google review. I guess I’m glad I didn’t put my full name on there when I first created my account!
How much did he get to drop Charges is what I want to know.
