A Florida teenager who brutally killed his mother while his newborn sister slept nearby has pleaded guilty to second-degree murder, accepting a 25-year prison sentence in a case that has shaken the Miami community since October 2023.
Guilty Plea Ends Two-Year Legal Battle
Derek Rosa, now 15, entered his guilty plea during a Friday hearing in Miami-Dade County court, avoiding a trial that was scheduled for later this month. The Hialeah teen had originally faced a first-degree murder charge in the death of his mother, Irina Garcia. Judge Richard Hersch questioned Rosa extensively before officially accepting the plea agreement, which reduced the charge from first-degree to second-degree murder in exchange for the 25-year sentence.
Rosa offered only two words to his family members assembled in the courtroom after the proceedings concluded. He looked at them and said simply, “I’m sorry.” Several family members became so overcome with emotion during the hearing that they had to leave the courtroom. The plea agreement also included a provision requiring Rosa to maintain no contact with his stepfather and his baby sister for the foreseeable future.
Horrific Details Of The Killing
The crime occurred on October 12, 2023, when Rosa was just 13 years old. Police reports indicate he entered his mother’s bedroom in their Hialeah apartment and stabbed Garcia 46 times while his newborn baby sister slept in a crib only feet away from the attack. A baby monitor in the room apparently captured footage of Rosa standing over his mother during the brutal assault. After the killing, Rosa called 911 himself and subsequently provided a full confession to police officers who responded to the scene.
Rosa’s stepfather delivered an emotional statement in the courtroom, addressing Rosa directly through a translator. He told the teenager that he had considered him like a son, and that Garcia’s murder had completely destroyed their family. The stepfather’s visible anguish reflected the devastating impact the crime has had on those who loved Garcia and once cared for Rosa as part of their family unit.
Legal Proceedings And Final Outcome
Last week, Judge Hersch denied a motion filed by Rosa’s defense attorneys seeking to suppress the teenager’s confession to police. The judge ruled that the confession would be admissible as evidence at trial, a decision that may have influenced Rosa’s choice to accept the plea agreement rather than proceed to a jury trial. Miami-Dade County State Attorney Katherine Fernandez Rundle released a statement following the plea, though specific details of her comments were not immediately available. The case represents one of the youngest defendants charged with murdering a parent in recent Florida history, raising difficult questions about juvenile justice and family violence that the community continues to grapple with today.

The boy needs help , no child would ever kill his own mother , unless he was mentally ill . Its just not normal !!!
Well, yeah, but she took away his Roblox! You can’t do that to a kid. That would make any kid want to kill his parent who takes it away!
Jealousy..
Baby sister took attn away he was used to getting
Step dad resentment
The only help he needs is to be stabbed 46 times also. Too bad they go light on anyone who commits murder, they should receive the same treatment as they administered, period!
Amen. Well said.
I agree 100%. An eye for an eye & maybe, just maybe, a criminal will think twice the next time.
This site calls my comment spam when I call for the death penalty to any convicted murderer, regardless of age, sex or affiliation.
Two bits says this a Muslim deal. Buda told him to do it!!!
No kid of 13 in their right state of mind would kill their Mother. He left the infant unharmed. The boy is mentally disturbed dysfunctional and unstable. He needs specialist psychological help. His actions will leave a permanent scar in his mind and blight his life as long as he lives no matter how much specialist intervention he receives.
