The WNBA now confronts potential legal action for discriminating against fans who support female-only sports, as the Alliance Defending Freedom warns the league may violate public accommodations laws by ejecting supporters of traditional women’s athletics from publicly-financed arenas.

Legal Threat Targets League Practices

Alliance Defending Freedom sent a legal warning to WNBA Commissioner Cathy Engelbert on Friday, highlighting that Seattle prohibits discrimination based on political ideology in public accommodations, while Washington D.C. bans discrimination for political affiliation. The organization emphasized that public ownership or financing of WNBA arenas may require teams to follow First Amendment norms, making enforcement actions against gender-critical fans particularly vulnerable to legal challenge across the league’s 15 teams.

The warning follows multiple incidents involving fans wearing XX-XY Athletics gear at Indiana Fever road games to show support for sharpshooter Sophie Cunningham and her opposition to males competing in women’s sports. Security responses have varied wildly. The WNBA suspended and fined Seattle Storm co-owner Celeste Keaton for verbally attacking teenage Cunningham supporters at a July game, though security refused to remove Keaton despite her harassment of the fans.

Idaho Coffee Shop Faces Similar Scrutiny

Idaho’s Wydaho Roasters ejected a Students for Life of America meeting last week, comparing pro-life Americans to the Ku Klux Klan and banning customers with pro-life views entirely. George Washington University law professor Jonathan Turley noted the coffee shop’s treatment of customers exceeds what Jack Phillips did in the Masterpiece Cakeshop case. Unlike Phillips, who refused to create custom products celebrating same-sex marriage, Wydaho Roasters banned customers for their beliefs alone, not for requesting specially designed products.

Idaho law prohibits discrimination based on religion in public accommodations. Pro-life views strongly correlate with church attendance, and survey data shows people who consider religion very important in their lives are the most anti-abortion. Idaho Attorney General Raul Labrador’s office did not respond to inquiries about potential application of public accommodations law to the coffee shop’s practices.

What This Means

The legal challenges represent a reversal for progressive activists who spent years pursuing Christian business owners for refusing to design products celebrating same-sex marriage and gender transition. Now organizations face potential liability for discriminating against customers based on gender-critical and pro-life viewpoints. At Sunday’s Fever-Chicago Sky game, former NBA player Enes Kanter Freedom was ejected as a fan after declaring for the WNBA draft, though authorities have not clarified which entity ordered his removal from the arena.
