The Department of Justice has filed criminal charges against Representative LaMonica McIver for allegedly assaulting two federal agents outside an Immigration and Customs Enforcement detention facility in Newark, New Jersey. Interim U.S. Attorney Alina Habba, formerly President Trump’s attorney, announced the charges, which include two counts of “assaulting, resisting, and impeding certain officers or employees.” Federal prosecutors filed the criminal complaint on May 19, marking a rare instance of federal criminal charges against a sitting member of Congress outside of corruption cases.

McIver claims she was conducting lawful oversight of detainee treatment when the confrontation occurred, but federal agents tell a different story. According to the criminal complaint, McIver refused to vacate a secure enforcement zone and physically confronted the federal agents who were attempting to do their jobs protecting American communities.
Democrats Claim Political Motivation Behind Charges
McIver and her Democratic allies have predictably characterized the charges as “purely political,” claiming they aim to deter legitimate congressional oversight. House Democratic leadership, including Hakeem Jeffries, issued statements supporting McIver, falsely asserting that the congresswoman and her colleagues were lawfully inspecting the facility when they allegedly interfered with federal immigration enforcement operations.
